Together For Our Children: Fighting Malaysia’s Worst Constitutional Amendment

In June 2023, the Malaysian Ministry of Home Affairs announced that it was seeking to pass a series of amendments to the Federal Constitution of Malaysia. While some proposed amendments, like allowing Malaysian mothers to pass their citizenship to their foreign born children, were lauded by civil society groups, most of the proposed amendments have been derided as draconian and, in the words of one lawyer, the worst amendment to the Malaysian Federal Constitution since Merdeka. 

These amendments risk creating generations of stateless people in Malaysia, needlessly prolonging the misery and cruelty imposed on them by the state via the removal of key constitutional safeguards. Should the amendments pass, thousands upon thousands of children may become stateless, a situation which deprives them of their basic rights to health and education. It will affect at-risk families who live at the periphery of society and who already lack access to government services. It will create a never-ending cycle of poverty, misery, and risk to those who need help the most.

We’ll be talking about the upcoming constitutional amendments together with activists, civil society members, and legal practitioners on what these amendments mean for our communities, why they should be halted, and how we, as ordinary citizens, can fight back together, to protect our stateless communities and ensure that they get what they deserve.
